Default Is there a good way to keep the white tail deer out of my vegetable garden?

They are eating everything! Killing them isn't an option.
Marigolds did nothing. Killing isn't an option because of the laws where I live.

I'm trying a fence made out of fishing line taped to poles at 3' above the ground. The concept is that the deer can't see the line and when they brush against it, they get scared and leave. Before I put it up I had several tomato plants eaten off but since the line is up, the garden has been left alone.

Why is it not an option? There are varmint laws that's a win, win situation. Get ya meat and tater's from the same patch!
